The Tennessee Court of Appeals upheld a lower court’s decision regarding a Livingston billboard request.
Roland Digital Media appealed the Livingston Board of Zoning Appeals’s (BZA) ruling to deny the company’s request to place a 264-square foot billboard within city limits.
City codes specify that signs in the commercial district must be under nine square feet.
Chancellor Ronald Thurman upheld the BZA’s decision, leading to another appeal being filed in the Tennessee Court of Appeals.
On Monday, the appeals court sided with Thurman’s ruling, saying that Roland Media failed to name the Livingston BZA in its petition.
The media company listed the City of Livingston and Mayor Curtis Hayes as the respondent. The BZA is separate from the city and Hayes does not serve on the BZA.
Ultimately the court found the previous ruling as correct and denied a motion to amend the petition.
