Livingston Zoning Appeals Denies Sign Request Appeal

The Livingston Board of Zoning Appeals Monday night denied a request for a new digital sign at 1125 West Main Street.

The request brought to the board for administrative review after the city’s Codes Enforcement Officer denied the application. The board decides if the sign application was properly denied. Codes Enforcement Officer Walter Rutherford pointed to the city’s new sign ordinance as to why he denied the application.

“According to the sign ordinance, it says that no flashing signs are allowed in any zoning in the city limits,” Rutherford said. “When you look at the definition of a flashing sign, basically, is any sign that’s not stationary that changes.”

Rutherford also stated that the type of sign did not meet the size requirements. Since the representative for the request was not in attendance and did not request to remove the agenda item, the board unanimously voted to affirm Rutherford’s decision to deny the application.

City Attorney Andre Greppin said that the board of zoning appeals not only can perform an administrative review but can also grant variances.

The board also had another administrative review to consider regarding a digital sign from Roland Media. Greppin asked that the board table the decision ahead of the meeting as the representative was unable to be in attendance.
