White Co. Planning Considering Property Division Changes

The White County Planning Commission is considering making changes to a rule that limits the division of property larger than five acres.

Planning Director Tommy Lee said White County regulations state that property, regardless of size, cannot be divided without at least 25 feet of road frontage that touches either a county-maintained road or a state-maintained road. Lee said the planning commission typically has not allowed divisions of property larger than five acres.

“We were just talking about potentially allowing divisions of property that are larger than five acres to be served with an easement instead of in lieu of road frontage,” Lee said.

Lee said a change to allow easements would likely give property owners more flexibility in dividing property. However, Lee said anytime easements are involved when dividing property, issues can occur later down the road.

“The original parties that agreed to it, there is typically no problems there,” Lee said. “It’s when other parties get involved because easements transfer with property, not with people.”

Lee said the planning commission has had brief discussions about a possible change over the past few months. Lee said he expects the planning to continue discussing the possible change.

Lee said it is still too early to tell if the planning commission will actually make the change.
