Spencer Consider Diverting Property Off College Street

Spencer Aldermen discussed diverting a piece of property on College Street across from the Spencer Church of Christ.

Alderman David Chandler said the property contains Clendenon Avenue, an old city street that has not been maintained since the 1930s. Chandler said the church believes the property is abandoned, as they have been maintaining it. Farmer said she searched through old meeting minutes to see if the property was ever deemed abandoned.

“That section between (Highway) 30 and where the back of the church of Christ, that section never was abandoned, I can’t find it anywhere,” Farmer said. “So that’s something that the board would have to decide, and if so, I would bring a resolution.”

City Attorney Edward Boring said nearly 100 years, he would consider the property abandoned. Farmer asked Boring if the land would be divided up equally between landowners if the city did divert the property. Boring said he believes that’s how the law works.

“I think that’s just basically how the law does it,” Boring said. “If you abandon it, we don’t divide it. I think it just goes to, you know, have the landowners split.”

Farmer asked Boring if the city would need to do a quick claim deed. Boring said a quick claim deed is not necessary.

“I would just give each landowner that’s affected by closing that road notice, which would be probably the two landowners that you are talking about,” Boring said. “Just give them notice we are gonna abandon it at this meeting, and just go through the process.”

Boring said a public hearing would not be needed for the action. Farmer said the board of aldermen will plan to act on diverting the property at the next meeting in June.
