Polochak’s Appeal Denied By State Supreme Court

The State Supreme Court has denied the appeal of Kalyn Polochak, convicted in 2010 by the Overton County Criminal Court for murder.

Attorneys argued that Polochak’s sixth amendment rights were violated. A statement by her-then boyfriend, Benjamin Bowers, was admitted in the trial. Attorneys argued Polochak did not have the chance to confront the witnessses against her.

The court dismissed the claim.

Polochak faces a virtual life-sentence on convictions of first degree premeditated murder, first degree felony murder, conspiracy to commit first degree murder, especially aggravated robbery, and theft of property valued at $1,000 or more but less than $10,000.

Bowers and Polochak were living with Bowers’ grandmother, who died from “asphyxia due to strangulation and smothering” in the December, 2010 incide
